As a part and parcel of my purchase of this Chopper One accessory,
I agree as follows:

1. I will take full responsibility for the safe use and handling of the Chopper One.
2. I will follow the basic safety precautions set forth in the instructions, including the wearing of safety glasses, safety shoes, and safety apparel.
3. I will only use the Chopper One to split wood in a safe area, understanding that the Chopper One can propel wood fragments ten feet or more.
4. I will not strike the Chopper One with another tool.
5. I will always practice safe wood splitting with the Chopper One.
6. I also agree to be fully responsible if the Chopper One that I purchase is provided to another person, and take responsibility for their safe use of the Chopper One as well.
7. I understand that Factory-One.Com, L.L.C is supplying this product to me with the understanding that I will assume the responsibility for my own, or anyone else's, use of the product which I am purchasing, and that I am assuming all risks related to any use or misuse of the product.
8. I understand that in no case will Factory-One.Com, L.L.C. be liable for any actual, incidental or consequential damages resulting from the use or misuse of the product I am purchasing, including damages for any claim or suit based upon negligence or product liability theories of liability.
9. I also agree to indemnify and save harmless Factory-One.Com, L.L.C, of and from all claims or suits arising out of or relating to any abuse or misuse of the product which I am purchasing.
10. I hereby remise and release Factory-One.Com, L.L.C. of and from any and all past, present and future claims or suits I have or may have (in the future or otherwise) relating to the use or misuse of the Chopper One I am purchasing, including any claims or suits based on alleged negligence or product liability of Factory-One.Com, L.L.C.
